Murphys Sanitary District June Meeting Chaotic & Uncontrolled

   A Continuing Investigation into the Murphys Sanitary District

 If you listen to the tape from the June 11, 2012 Murphys Sanitary District Board meeting, you will hear long and loud discussions, comments and questions not directed to the Chair of the Board, as should be required by the Chair  and with no one stating their names before they speak.
   Mr. Peccia spoke angrily from the audience demanding  that the District should be cleaning out either the lateral sewer lines or at the main, based on the practice done in past years.  In many instances during the meeting, the discussion became so out of control that you couldn't tell what was going on. This issue ended up being tabled.
     Julio Guerra, General Manager,  continually tried to keep the Board in some order, and reminded them to speak one at a time and directly to the Chair, not to each other, but after a couple of minutes they were all again talking to each other. Mr. Guerra should not have to be a babysitter of the Board.
      A discussion took place regarding the workman's comp case that resulted from mold in the ceiling at the MSD office in which an employee became ill.  The material was never examined and tested for the type of mold. as it was removed from the premises by Mr. Davies, who owns the building.
    The Board requested that it be returned by Mr. Davies, who argued that it was the same material  as if you punched a hole anywhere.  The District was instructed to write a letter by Certified mail that they need to test the mold that was removed.
     A discussion took place to possibly hire someone else to test the material. It was explained to Mr. Davies that Workmans Compensation law requires it.  Mrs. Davies, who sits on the Board of Directors, left  the room, but her husband, Mr. Davies, remained as the landlord.
     Why was Mr. Davies allowed to take the material with him, and why did he make a statement that the employee must prove it was not a false claim. (Did we understand that correctly?) Someone mentioned that there was no reason to believe it was a false claim. The chain of custody of the evidence from the ceiling is proven to be ?????
    Without Mr. Guerra having some control, and reminding the Board about proper procedure, this meeting may have been even worse, in our opinion.
     It is the suggestion of this newspaper that someone get each Board member a copy of Roberts Rules of Order and get their act together, especially the Board Chair.
