September 22, 2012: According to CHP, Leticia Avalos 41, of Oakland, was driving a 2001 GMC pickup westbound on Meadow Drive, west of Wawona Way in Arnold at approximately 20 MPH.
Avalos claims that
a deer jumped out in front of her and she swerved to the left in order to avoid the deer.
However, due to Avalos' level of intoxication, per CHP she was unable to maintain control on the pickup.
The pickup crossed into the opposing lane and continued off the roadway where the front end collided with a dirt embankment.
Avalos' claim that a deer ran out in front of her could not be substantiated due to a lack of an independent witness or physical evidence.
Avalos was placed under arrest, according to CHP, for misdemeanor DUI and was booked into the Calaveras County Jail and charged with felony DUI based on the injuries sustained by her passenger.
Both the driver and the passenger, Mark Kaufman, 54 of Pleasanton, were transported to Mark Twain Hospital with moderate injuries.
