On Sunday, January 13, 2013, at approximately 12:07 PM, according to the Angels Camp Police, an officer responded to a reported non-injury traffic collision near the intersection of Hwy 4 and 49.
Upon arrival the officer spoke with the involved parties and found that one of the two drivers involved was complaining of minor pain to her neck and back after being rear-ended by the other vehicle involved.
The second person involved, Joshua J. Fernandes, a 26-year-old Angels Camp resident, initially told the officer that he was not suffering from any pain or injuries.
During the course of speaking with Fernandes the officer determined that he displayed symptoms associated with being under the influence of narcotics.
The officer conducted an investigation and Fernandes was subsequently arrested for suspicion of driving a motor vehicle while under the influence of drugs, according to the department report.
Subsequent to being placed in handcuffs Fernandes became hostile and combative and he turned toward the officer several times, intentionally stepping on the officer's feet and spitting on the officer.
Fernandes also intentionally slammed his head into the hood of the patrol car, denting the hood of the patrol car.
Fernandes was transported to Mark Twain Medical Center for a blood draw and for a medical clearance prior to being booked into jail, and he is facing criminal charges related to Driving Under the Influence, Assault and Battery on a Peace Officer, Resisting arrest and Vandalism.
