After going over the letter that Mokelumne Hill Fire District wrote, and reviewing the draft MSR for that district, we did see a couple of problems. For one, why are there different MSR's?
If Jennifer Stephenson, a LAFCO employee, called the Grand Jury and the Grand Jury spoke with her, saying that there is a pending investigation, there was a violation of privacy.
The Grand Jury is not allowed to make public any information about any ongoing investigation. We have asked Ms. Stephenson who she spoke to at the Grand Jury? Who confirmed an investigation was ongoing?
Whoever that Grand Jury member was could be in serious trouble for that act. We have also left a message at the Grand Jury office.
John Benoit, who is the Executive Director of LAFCO, told us that they are going to review that portion of the MSR and if that part should be stricken in the final MSR that he is sure it will be stricken.
In the meantime, the Grand Jury has made it all public and this information could be added by LAFCO to the MSR for Moke Hill Fire District at the present time.
This is a question of timing on the part of the Grand Jury and LAFCO personell. Mr. Benoit tells us that he sent the MSR to the members of the LAFCO Board, local fire chiefs and posted it on their website, that he did not send it to any other member of the press or any other website.
